Please read these Terms & Conditions (“Terms”) carefully before using the EloX mobile application (the “App”) operated by Bhan AS (“we”, “us”, or “our”).
By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Description of the Service
EloX is a mobile application that lets users log real-life match results (such as chess, table tennis, and other competitive games) and tracks skill ratings using the Glicko-2 rating system. Match results are confirmed by both participating players via a QR code exchange. Ratings are used to maintain leaderboards visible to other users.
2. Eligibility
You must be at least 13 years old to use the App (or such higher age as required by applicable law in your jurisdiction). By using the App you represent that you meet this requirement. If you are under 16 years old and located in the EU/EEA, you must have consent from a parent or guardian.
3. Account Responsibilities
You are responsible for:
- Keeping your account credentials secure and not sharing them with others.
- All activity that occurs under your account.
- Choosing a username that does not impersonate others or violate third-party rights.
- Notifying us promptly if you suspect unauthorized access to your account.
You may only create one account per person. Accounts are personal and non-transferable.
4. Acceptable Use
You agree not to:
- Log false or fraudulent match results.
- Manipulate ratings or leaderboards through collusion, match-fixing, or other artificial means.
- Use the App to harass, abuse, or harm other users.
- Submit unlawful, abusive, misleading, or infringing usernames, profile information, suggestions, or other content.
- Attempt to reverse-engineer, scrape, or interfere with the App or its backend systems.
- Use the App for any commercial purpose without our prior written consent.
- Upload or transmit malicious code, spam, or unlawful content.
We reserve the right to investigate suspected violations and take appropriate action, including account suspension or termination.
5. Rating System and Leaderboards
Ratings are calculated automatically using the Glicko-2 algorithm applied server-side. We do not guarantee the accuracy, fairness, or fitness for any particular purpose of ratings displayed. The rating system is provided for entertainment and informal competition purposes only.
A rating is considered “provisional” until a user has completed at least 10 confirmed matches against 5 unique opponents with an uncertainty (RD) at or below 200. Provisional ratings are only visible to the account holder and not displayed on public leaderboards.
We reserve the right to adjust, recalculate, or reset ratings at any time, including to correct errors, address abuse, or change the rating methodology.
We reserve the right to remove matches, adjust ratings, or restrict accounts where we reasonably believe fraudulent or abusive activity has occurred.
6. User Content
By submitting a username, profile information, match confirmation, suggestion, or other content, you grant us a non-exclusive, royalty-free license to host, store, process, and display that content within the App and associated services. You represent that your content does not infringe any third-party rights.
7. Intellectual Property
All content, design, code, and trademarks associated with EloX are the property of Bhan AS or its licensors. Nothing in these Terms grants you any rights to our intellectual property beyond the limited right to use the App as described herein.
8. Termination
We may suspend or terminate your account at our discretion, with or without notice, if you violate these Terms or if we reasonably believe it is necessary to protect the App, comply with legal obligations, or enforce these Terms. You may delete your account at any time through the App's account deletion feature or by contacting us at support@bhan.no. Upon termination, your right to use the App ceases immediately.
9. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BHAN AS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) EUR 100.
Some jurisdictions (including EU member states) do not allow certain liability exclusions, so the above may not apply to you in full.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email at least 30 days before the changes take effect (where required by law). Your continued use of the App after the effective date constitutes acceptance of the updated Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of Norway, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the courts of Norway, provided that nothing herein limits your rights under mandatory consumer protection laws applicable in your country of residence.
13. Severability
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
